That isn't "discrimination" as defined today
Today, the Federal government says that you can't discriminate based on race, national origin, religion, sexual orientation, and sex.
So, the ACC could say "no" to WVU based on their economics, but couldn't say "no" to Hampden-Sydney based on it being single sex, or Liberty being Baptist.
All of that being said, the sponsoring schools would know exactly if the school they sponsor would actually be approved before formally submitting the application. This is the first rule of politics, never have a vote unless you know in advance what the outcome will be.
